Purchaser / Attendee Terms

1. Scope — MrStubs Is Not the Seller
These Purchaser/Attendee Terms ("Attendee Terms") apply when you buy, receive, or hold a ticket to an Event through the MrStubs Services. They are part of and incorporated into the MrStubs Terms of Service ("ToS"). Capitalized terms have the meanings given in the ToS.
When you buy a ticket, your purchase contract is with the Organizer of the Event, not with MrStubs. MrStubs is a technology platform and a limited payment-facilitation conduit. MrStubs is not the seller, the merchant of record, the organizer, or the owner of any Event, does not sell tickets, and never holds your ticket payment.
Your payment is processed directly to the Organizer through the Organizer's own Payment Processor account.
2. Account and Guest Checkout
You may purchase a ticket by creating an account or, where offered, through guest checkout. You agree to provide accurate information. You are responsible for activity under your account and for keeping your credentials secure.
3. Refunds Are the Organizer's Responsibility
The Organizer sets, honors, and funds the refund policy for its Event. MrStubs does not control, decide, or fund ticket refunds.
If you want a refund or have a question about one, you must contact the Organizer and follow the Organizer's refund policy as disclosed at purchase. MrStubs cannot issue ticket refunds because MrStubs never holds your ticket payment. Platform Fees are non-refundable except as stated in the Refund and Chargeback Policy . See the Refund and Chargeback Policy for the minimum standards MrStubs requires Organizers to meet.
4. Pricing and Fees
The total price you are shown before you provide payment information is the all-in price for your ticket, including mandatory fees. The Organizer is responsible for displaying accurate, all-in pricing for its Event. Some amounts, including Platform Fees, are non-refundable as described in the Refund and Chargeback Policy.
5. Ticket Validity, Delivery, and Entry
Your ticket is delivered through the Services or as the Organizer specifies. The Organizer controls admission to its Event, including the rules for entry, identification, conduct, and any age or capacity restrictions. The Organizer, not MrStubs, decides who is admitted and may refuse or revoke admission under its rules and applicable law.
6. Ticket Transfer, Resale, and Anti-Bot Rules
Whether a ticket may be transferred or resold, and on what terms, is set by the Organizer. You must not use any bot, automated system, or other technical means to circumvent ticket-purchasing limits or security measures, or to acquire tickets, in violation of the Better Online Ticket Sales Act, 15 U.S.C. § 45c, and you must not resell tickets acquired in violation of that Act. Tickets acquired through fraud or in violation of these Attendee Terms may be cancelled.
7. Assumption of Risk for Event Attendance
Attending an Event is at your own risk. MrStubs is not responsible for any Event, for the conduct of any Organizer, performer, venue, or attendee, or for any injury, loss, or damage arising from an Event. Any concern about an Event's safety, content, accessibility, or conduct is a matter between you and the Organizer.
8. Prohibited Conduct
You must comply with the Acceptable Use Policy in ToS Section 7. You must not scrape the Services, use bots, interfere with the Services, or use the Services for any unlawful or fraudulent purpose.
9. Privacy
When you buy a ticket, your personal data is shared with the Organizer, who is the controller of that data and is responsible for how it is used. MrStubs processes Attendee data on the Organizer's behalf as a processor, and also handles certain data as a controller, as described in the Privacy Policy. Please read the Privacy Policy for details about how your data is collected and used and about your privacy rights.
10. Disclaimers, Limitation of Liability, and Release
The disclaimers of warranties in ToS Section 13, the limitation of liability in ToS Section 14, and the release in ToS Section 15 apply to you and are incorporated here. BECAUSE MRSTUBS IS NOT THE SELLER OR MERCHANT OF RECORD AND NEVER HOLDS YOUR TICKET PAYMENT, MRSTUBS IS NOT LIABLE FOR ANY EVENT, FOR ANY ORGANIZER'S REFUNDS OR CONDUCT, OR FOR ANY TICKET PURCHASE. Any dispute about a ticket or an Event is between you and the Organizer.
11. Arbitration, Class-Action Waiver, and Governing Law
Your disputes with MrStubs are subject to the binding individual arbitration agreement, class-action waiver, jury-trial waiver, and 30-day opt-out in ToS Section 18, and to the Wyoming governing-law and venue terms in ToS Section 19. PLEASE READ THOSE SECTIONS CAREFULLY; THEY AFFECT YOUR LEGAL RIGHTS.
Disputes about a ticket or an Event itself are with the Organizer, not MrStubs.
